Photo Booth Rentals

1. Use of Photo Booths

Participant agrees to use the Photo Booths solely for their intended purpose of capturing photographs, videos, or other media provided by MM Visuals LLC.

Participant agrees to properly care for all equipment, props, décor, backdrops, electronic devices, or other property belonging to Owner. Participant accepts full responsibility for any loss, theft, damage, or destruction of Owner’s property during their use and agrees to pay the replacement cost for any such damage.

Participant also agrees to leave the Photo Booths and surrounding area in the same condition in which it was provided.

2. Assumption of Risk

Participant acknowledges that using the Photo Booths and participating in related activities may involve inherent risks of physical injury, illness, permanent disability, property damage, or death.

PARTICIPANT VOLUNTARILY, KNOWINGLY, AND FREELY ASSUMES ALL RISKS — BOTH KNOWN AND UNKNOWN — ASSOCIATED WITH THE USE OF THE PHOTO BOOTHS, INCLUDING BUT NOT LIMITED TO: bodily injury, illness or exposure to disease, property damage, permanent disability, or death — including risks arising from the negligence of Owner or Released Parties.

3. Release from Liability

Participant, for themselves and their heirs, assigns, and personal representatives, fully and forever releases and discharges Owner and Released Parties from any and all claims, demands, causes of action, liabilities, expenses, or costs of any kind arising from or related to their use of the Photo Booths — including claims for bodily injury, illness, permanent disability, property damage, or death — even if caused by the negligence of Owner or Released Parties.

4. Covenant Not to Sue

Participant agrees not to initiate or assist in the prosecution of any claim, demand, or lawsuit against Owner or Released Parties for any personal injury, illness, death, or property damage arising from their use of the Photo Booths.

5. Indemnification

Participant agrees to defend, indemnify, and hold harmless Owner and Released Parties from any claims, demands, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from their use of the Photo Booths, including claims for injury, illness, death, or property damage — even if caused by the negligence of Owner or Released Parties.

6. No Representations by Owner

Participant acknowledges that the Photo Booths and any equipment provided are accepted in “AS IS” condition without warranties of any kind, expressed or implied.

7. Photo & Media Release

Participant grants MM Visuals LLC (“Owner”) and its representatives the unrestricted right to capture, use, reproduce, and publish photographs, videos, or other media taken in connection with the use of the Photo Booths.

Participant understands and agrees that such media may be used for any lawful purpose, including but not limited to marketing, advertising, social media content, promotional materials, or other commercial purposes — in any format now known or later developed — without compensation, notice, or further approval.

Participant waives any right to inspect or approve the finished product wherein their likeness appears and releases Owner from any liability related to the use of such media.

8. Health & Safety Acknowledgment

Participant acknowledges that participating in events may expose them to communicable diseases, including but not limited to COVID-19 or other illnesses, and assumes all such risks. Participant releases Owner and Released Parties from any liability relating to exposure, injury, illness, or death resulting from such exposure.

9. Governing Law & Venue

This Agreement shall be governed by and construed under the laws of the State of California. Any legal action arising from this Agreement shall be brought exclusively in the state or federal courts located in San Diego County, California.

10. Arbitration (Optional Dispute Resolution)

Any dispute arising from this Agreement shall be resolved by binding arbitration in San Diego County, California, in accordance with the rules of the American Arbitration Association.

11. Waiver

No waiver of any provision of this Agreement shall be valid unless in writing signed by Owner.

12. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior communications.

Parent or Legal Guardian Acknowledgment (If Under 18)
